The Surrogacy (Regulation) Act, 2021 permits only altruistic surrogacy — where the surrogate carries the baby without commercial compensation. Commercial surrogacy is banned in India.

  • Married couples where the woman has a medical condition making pregnancy impossible (e.g., absent uterus, repeated IVF failure)
  • Widowed or divorced women (single women aged 35-45)
  • The surrogate must be a close relative of the intending couple
